How To Begin Arbitration Proceedings
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our address as posted on the Website Services, Attention: General Counsel. The arbitration will be conducted by the American Arbitration Association (referred to as "AAA") under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. We will reimburse those fees for claims totaling less than $250.00 unless the arbitrator determines the claims are frivolous. Likewise, we will not to seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You or we may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.
YOU AGREE WITH US THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS action, CONSOLIDATED action OR REPRESENTATIVE ACTION.
IF, FOR ANY REASON, ANY CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AGREE WITH US TO ONLY BRING YOUR CLAIM ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS action, CONSOLIDATED action OR REPRESENTATIVE ACTION.
BY AGREEING TO THE ABOVE, YOU ARE AGREEING TO WAIVE ANY RIGHTS THAT YOU MAY HAVE TO BRING CLAIMS IN A CLASS action, CONSOLIDATED action OR REPRESENTATIVE ACTION.

Dignity Health has undertaken an effort to remove barriers to access throughout Dignity Health's hospitals.The effort has been undertaken as part of the settlement of a class action civil complaint filed by individuals with mobility, vision and hearing impairments who filed a lawsuit in the United States District Court for the Eastern District of California in 2006.The lawsuit alleges that persons with disabilities encountered barriers to access within Dignity Health facilities.In order to resolve the lawsuit and improve the access to Dignity Health services for persons with such disabilities, Dignity Health has agreed to take the following actions:

(2) Identify and remove physical access barriers in all public areas at each Dignity Health facility. This process involves inspections of facilities beginning in 2007 and construction projects that will be completed generally within three years of such inspections.The process for all Dignity Health facilities is expected to be completed by 2019.Dignity Health is committed to permanently removing access barriers and to appropriately addressing access to its facilities in the interim.Reports about physical access barriers encountered by disabled persons may be made to the law firm identified above or to Dignity Health's ADA Reporting Hotline listed below.Requests for immediate assistance should be directed to a hospital staff member or to a hospital's Administrative Offices.
(3) Update policies affecting disabled persons.Individuals whose impairments make it difficult to access services at Dignity Health facilities will be provided with appropriate assistance.Among other things, this may include reading written information to vision impaired persons, providing visual communication for those who are hearing impaired, and ensuring the availability of special medical equipment in order to treat those who require it.
(4) Provide a mechanism for individuals to contact Dignity Health directly with complaints, concerns or requests regarding access for persons with disabilities.Any reports about access made to the following telephone number will receive prompt and appropriate attention:

PLEASE READ CAREFULLY.THIS STOS CONTAINS INSTRUCTIONS ON HOW TO USE THE ONLINE PATENT CENTER.THIS STOS GOVERNS YOUR ACCESS TO AND USE OF THE ONLINE PATIENT CENTER.BY SUBSCRIBING TO, ACCESSING OR USING THE ONLINE PATIENT CENTER, YOU ARE NOW ACCEPTING ALL OF THESE TERMS AND SERVICE.
PLEASE NOTE THAT SOME RELATED WEBSITES AND THEIR SERVICES (INCLUDING SPECIFIC FUNCTIONALITIES) MIGHT BE SUBJECT TO ADDITIONAL OR OTHER TERMS OF SERVICE.BY USING ANY RELATED WEBSITE OR SUBSCRIBING TO OR USING ANY OF THE SERVICES ON THOSE WEBSITES, YOU ARE ACCEPTING ALL OF TERMS OF SERVICE THAT APPLY TO THOSE WEBSITES AND SERVICES AS A CONDITION OF USING THOSE WEBSITES AND SERVICES.
1.PERMITTED ACCOUNT HOLDERS
It is our policy that only adults (18 years of age and older) and patient representatives of minors 11 years of age and younger may access and use the Online Patient Center as account holders.In the case of joint custody of a minor, one partner of a joint custody arrangement will have read-only access to the minor's online health records and the other partner will have write-only access to that minor's online health records.
2.ENROLLMENT AND VERIFICATION OF IDENTIFY
Your enrollment in the Online Patient Center is conditioned on verification of your identity by one of our representatives in person and with photo identification. When you first enroll in the Online Patient Center, you will receive a temporary access code from your Dignity Health clinic.This access code is for a one-time use.It will permit you to create a user identification (referred to as a "User ID" in this STOS) and password, which is necessary to access and use the Online Patient Center.Once you have created your User ID and password, you are deemed "enrolled" in the Online Patient Center. If you fail to use your temporary access code within sixty (60) days of receipt, it will expire and you will need to obtain a new temporary access code from us in person to enroll in the Online Patient Center.
3.ONLINE ID AND PASSWORD/ACCOUNT SECURITY
(a) Inquiries and entries that you make within the Online Patient Center will be logged in association with your User ID.It is extremely important that you keep your Online Patient Center User ID and password completely confidential, as anyone with access to your User ID and password will be able to assume your online identity, view your confidential medical information, send and receive electronic communications, add comments to your record and communicate with your health care provider.
(b) It is your responsibility to prevent disclosure of your User ID and password.If you believe the security of your User ID and password have been compromised, lost, stolen, viewed, or misused, you must notify us immediately and change your User ID and password.In addition, in order to maintain the security of the Online Patient Center, you may be required to change your password periodically, without prior notice, upon login and before you are allowed access to your account.If you have any questions regarding the security of your User ID and password, please telephone our HELPLINE at 1-888-737-0220
(c) If it is discovered that you have inappropriately shared your password with another person or otherwise misused or abused your privileges to access or use the Online Patient Center, we reserve the right to immediately discontinue your access to the Online Patient Center without prior notice.
(d) We take no responsibility for and disclaim any and all liability arising from a breach of health record confidentiality resulting from your sharing or losing your User ID and password or otherwise failing to keep it confidential.
4.HEALTH INFORMATION AND TEST RESULTS AVAILABLE AT THE ONLINE PATIENT CENTER
(a) You give us the right to deliver to you individually identifiable health information about you via the Online Patient Center, unless expressly forbidden by law.This may include, but is not limited to, laboratory, radiology and other test results, summary of medical issues, history, medications and allergies.Your physician verifies all results prior to release to you via the Online Patient Center.For those radiology results that have potential sensitivity to you as a patient, your physician will also obtain your consent prior to making the result available to you via the Online Patient Center.Nevertheless, often the information contained on the Online Patient Center may contain only portions of information within your medical record and may not necessarily reflect your complete health record.A complete copy of your health record can be obtained by contacting your healthcare provider's office directly or if a hospital, then the Medical Records Department.
(b) If you decide you no longer would like electronic delivery of your test results via the Online Patient Center, please call our HELPLINE at 1-888-737-0220 to deactivate your account.Not all test results are posted to the Online Patient Center.Therefore, it is your sole responsibility to request and verify results for all tests you have taken by contacting us directly.
5.YOUR RESPONSIBILITIES AS AN ACCOUNT HOLDER AND PROHIBITED ACTIVITIES
(a) You agree that you are solely responsible for any information that you communicate to others via the Online Patient Center.Since our supporting staff other than your individual health care provider may be involved in receiving your communications on the Online Patient Center, you should not use the Online Patient Center for confidential information that you wish to discuss only with your personal health care provider.You are responsible for any use of the Online Patient Center by your representatives or dependents, and you agree to inform them of this STOS and such individuals' obligations to comply with them.
(b) You agree to use the Online Patient Center only to post, send and receive messages and material that are proper and related to the particular service.You further agree that, when using the Online Patient Center, you will not do any of the following:
(i) Disrupt the normal flow of dialogue and/or exchange on the Online Patient Center, including posting or otherwise transmitting material that is not related to the subject at issue or otherwise restricts or inhibits any other use from using and enjoying the services on the Online Patient Center.
(ii) Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
(iii) Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
(iv) Publish, post, upload, distribute or disseminate any medical information you know to be inaccurate or incomplete.
(v) Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
(vi) Upload files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of the Online Patient Center or another user's computer.
(vii) Advertise or offer to sell or buy any goods or services for any business purpose.
(viii) Conduct or forward surveys, contests, pyramid schemes or chain letters.
(ix) Download any file posted by another user of the Online Patient Center that you know, or reasonably should know, cannot be legally distributed in such manner.
(x) Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
(xi) Violate any part of this STOS governing access to and use of the Online Patient Center or the main Terms of Service.
(xii) Violate any applicable laws or regulations.
(c) We have no obligation to monitor content that you post on the Online Patient Center. However, we reserve the right to review content posted to the Online Patient Center and to remove any content in our sole discretion.
6.YOUR CURRENT EMAIL ADDRESS AND SECURE ACCESS
(a) Keep your email address current:It is your responsibility to provide a correct and up-to-date email address to us so that we may notify you of new information waiting for you at your account within the Online Patient Center, regarding any updates and changes to the Website Services at the Online Patient Center, as well as any changes to this STOS. These notification e-mails will not contain any personal health information. When choosing an e-mail address to provide to us for these purposes, you should choose an e-mail account that you regularly check and that is solely used by you. Also, you should configure that e-mail account so that e-mails from DoNotReply@DignityHealth.org (notification specific) or TechHelpPatientCenter@DignityHealth.org (portal technical support centric) do not automatically go into bulk, trash or spam folders.
(b) Secure online messaging with us:We offer our patients secure, web-based electronic messaging through the Online Patient Center with the office of their healthcare provider.This messaging takes place via a secure Internet connection.Your connection, however, may not be secure if you are using somebody else's Internet connection or somebody else's computer.It also may not be secure if you are using WiFi that is not secure or you haven't installed all security updates available for your computer.If your WiFi connection is not secure, it is advisable not to use the Online Center until you can reach a place with a secure connection.
(c) If your health care provider or his or her staff is not available, your messages sent through the Online Patient Center may be forwarded to other appropriate health care providers and their staff for their action. They may also respond to you.
(d) The Online Patient Center is not intended to replace in-person meetings and/or personal conversations with your health care provider. If the Online Patient Center is unavailable, you should use other means to contact your health care provider for non-urgent matters.
7.ADDENDUM OR AMENDMENT TO YOUR MEDICAL RECORD
Please note that the contents of any Online Patient Center communications or message may become part of your permanent health record.If a message is made part of your record, it will be accessible to our current and future health care providers who are involved in your care.Nevertheless, such communication and messaging do not constitute an addendum or amendment to your existing medical records and may not be considered part of our designated medical record set.To exercise your legal rights in requesting an addendum or amendment of your medical records, please contact your healthcare provider's office or if a hospital, it's Medical Records Department.
8.RISKS TO YOU WHEN USING ELECTRONIC COMMUNICATIONS
(a) We request that you use the messaging function of the Online Patient Center, instead of e-mail, for online communications with your health care providers.We cannot respond to email requests.
(b) Please note, however, that while we take measures to safeguard your security, we cannot guarantee security of our systems against inadvertent disclosure or intentional intrusion.Risks of using electronic communications systems include, but are not limited to, the following:
(i) Electronic communications can be copied, circulated, forwarded and stored, in numerous paper and electronic files.
(ii) Electronic communications can be accidentally broadcast worldwide and received by many unintended recipients.
(iii) Backup copies of electronic communications may exist even after the originator or recipient has deleted his or her own copy.
(iv) Employers (when you are using the Online Patient Center via your employer's network) and online services have a right to archive and inspect e-mails transmitted through their systems.
(v) Message senders can misaddress a message. Messages can be intercepted, altered, forwarded or used without written permission or detection.
(vi) E-mail notifications can be used to introduce viruses into computer systems.
(vii) Electronic communications may not be answered in the time frame expected by the parties or they can be misinterpreted.
(viii) Electronic communications are discoverable and can be used as evidence in court.
(ix) Passwords providing access to electronic communications can be stolen and misused, or host systems can be compromised, leading to unauthorized disclosures of personal information.
(c) As a result of these risks, we cannot guarantee the security and confidentiality of electronic communications (including, but not limited to, messaging) submitted through the Online Patient Center, and will not be liable for improper disclosure of confidential information.
YOU ACKNOWLEDGE AND AGREE THAT YOU ASSUME THE SOLE RISK OF ANY INTENTIONAL INTRUSION, UNAUTHORIZED DISCLOSURE, FAILURE, DELAY, INTERRUPTION OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF ELECTRONIC COMMUNICATIONS RELATING TO THE ONLINE PATIENT CENTER.
9.ONLINE PATIENT CENTER AVAILABILITY
Although we will try to communicate when the Online Patient Center will be unavailable due to maintenance, backup procedures or other system outages, providing such advance notice may not be possible at all times and we cannot guarantee that you will be able to access the Online Patient Center at any particular time.When the Online Patient Center is unavailable, please use other communication methods (such as the telephone) to contact your health care provider(s) for non-urgent matters.
10.ACCOUNT DEACTIVATION, SUSPENSION AND DISABLING
(a) You are responsible for your content that you post on the Online Patient Center and the consequences of posting or otherwise transmitting such content on the Online Patient Center.We do not represent or guarantee the accuracy or reliability of any information or materials posted or otherwise transmitted by users of the Online Patient Center, or endorse any opinions expressed by such users.
(b) We do not generally screen, monitor or approve in advance content posted by patients.However, we may, from time to time, participate in communications on the site, or review communications on the site.If we identify content that violates this STOS or violates the law, or if we receive notification about a user on the Online Patient Center regarding content which allegedly violate this STOS or violates the law, we have the right, but not the obligation, to investigate the allegations and determine in our sole discretion whether to remove or request removal of the content and take any other steps we deem appropriate, including deactivation of the user's account.
(c) We reserve the right to expel users of the Online Patient Center and prevent their further access to the Online Patient Center for violating these STOS or violating the law. We may immediately, without prior notice, issue a warning, temporarily suspend, indefinitely suspend or terminate your use of and access to the Online Patient Center, in our sole discretion, for any reason, whether with or without cause or warning, and without liability.
(d) Your sole remedy against us in the event of a dispute arising out of these STOS or related to your use of the Online Patient Center, is to deactivate your account on the Online Patient Center or stop your use of the Online Patient Center.In the event of termination of your Online Patient Center account, we may delete and/or store, in our sole discretion, data associated with your use of the Online Patient Center.We may also change, suspend or discontinue any aspect of the Online Patient Center for any reason at any time, including the availability of any web site feature, database, or content.If we suspend or discontinue your account, we will attempt to notify you at the email address you currently have on file with us.
